Estate representative sues for wrongful death and negligence

WINFIELD – A personal representative for the estate of a West Virginia woman has filed suit alleging wrongful death and negligence. 

Teresa Lucas, the personal representative for the Estate of Deloris Hillier, filed suit in Putnam County Circuit Court on Aug. 14 alleging wrongful death and negligence against CAMC Teays Valley Hospital, Inc. 

Hillier was a patient at CAMC Teays Valley Hospital in August 2011, where she was admitted for treatment of a fractured left hip. She later suffered from skin breakdown, which allegedly  could have been avoided with adequate care. This alleged negligence and carelessness contributed directly to Hillier's harm, injury and ultimately, her death, claims the plaintiff. 

The plaintiff is suing for negligence, reckless misconduct and wrongful death. She seeks a trial by jury for damages and incurred expenses.

The plaintiff is represented by Andrew L. Paternostro and Jeff D. Stewart of The Bell Law Firm PLLC of Charleston. The case had been assigned to Circuit Judge Phillip Stowers.
