Driver sues trucker, alleging injuries sustained in accident

BECKLEY – A Raleigh County truck driver suing another trucker and his company, alleging injuries sustained to himself and damage to his car in a traffic accident.

Jerry R. Lilly of Beckley filed a lawsuit in Raleigh Circuit Court against Brett Feller and Multifresh Inc., doing business as Crook Brothers.

According to the complaint, on Aug. 20, 2013, Lilly was driving a Mack container truck on behalf of B&B Transit on Interstate Highway 77 near Flat Top when Fuller took his eyes off the road and failed to maintain control of his vehicle, colliding with Lilly's truck. The suit says Lilly suffered injuries to the ribs, legs, hands, shoulder and head in the collision and was forced to seek medical attention.

The lawsuit states the plaintiff's medical bills caused by the accident total $18,203.60.

Lilly seeks reimbursement of said bills, plus additional restitution for emotional and physical trauma and other damages, plus further relief as the court deems just. He is represented by attorney Paul W. Roop II of Roop Law Office in Beckley.
