Barbour County couple sues over defective ATV that allegedly started fire

PHILIPPI – A Barbour County couple is suing two two companies, alleging an ATV caught fire and damaged their garage.

Raymond and Mary Farris filed a lawsuit Aug. 24 in Barbour Circuit Court against St. Moritz Marine Service, Inc and Bill's Marine Service, alleging a defective ATV caught fire and damaged their garage extensively.

According to the complaint, on Aug. 25, 2013, after parking the ATV in their garage, the vehicle caught fire without warning, damaging both the Farris garage, plus a nearby ATV vehicle, among other items.

The suit says the cause was traced back to an auxiliary battery installed by the seller and a faulty wire therein. The plaintiffs charge the seller did not reveal something was wrong with the vehicle, plus improper installment of the aforementioned battery upon purchase.

The Farrrises seek the resulting cost of damages, and for annoyance and inconvenience, plus interest, court and attorney fees and other relief the court deems proper. They are represented by attorneys Hunter Mullens, of Mullens & Mullens in Philippi, and Christopher P. Deegan of Weber Gallagher Simpson Stapleton Fires & Newby of Pittsburgh.
