Sunbelt Tractor & Equipment sues Pipeline Energy over unpaid rental fees

WEST UNION—A Texas enterprise doing business in West Virginia is suing a Doddridge County energy company in an undated contract dispute.

Sunbelt Tractor & Equipment Company of College Station, Texas, filed a lawsuit against Pipeline Energy Group in Doddridge Circuit Court Aug. 19, alleging breach of contract in its contractual agreement to rent equipment from the plaintiff.

According to the complaint, all equipment, goods, wares, merchandise, materials and/or services were duly provided by the plaintiff in the regular course of its business. The suit states the fees for leasing were reasonable and customary.

Alleging unjust enrichment as well as breaking the terms of the agreement, Sunbelt Tractor & Equipment Company says the defendant is indebted for at least $70,106.81. The suit states the exact amount will be proven at trial. The lawsuit says all conditions precedent to recovery have been performed or have occurred.

Sunbelt Tractor and Equipment seeks actual and compensatory damages, pre- and post-judgment interest, attorney fees and costs. It is represented by attorneys Michael Proctor and Alex Greenberg of Dinsmore & Shohl in Morgantown. The case has been assigned to Circuit Judge Timothy L. Sweeney.
