PINEVILLE – A Virginia woman says she was injected with a counterfeit injectable wrinkle filler that caused her injury.
Kimberly G. Bourne and her husband William J. Bourne filed their complaint last month in Wyoming Circuit Court against Zen Health Wellness and Beauty Clinic of Beckley. Zen President Shashikant Bhavsar resides in Wyoming County, according to the complaint.
In the complaint, Bourne says she went to Zen on Aug. 23, 2013, and was injected several times with two syringes of what she believed was Restylane by employee Heather McKinney.
“Plaintiffs are advised and therefore believe the Restylane that was injected into Kimberly G. Bourne’s face was a counterfeit substance,” the complaint states. “Plaintiffs are further advised and therefore believe defendant … knew or should have known that such Restylane was a counterfeit substance and that it should not have been injected into … Bourne’s face.”
She also says McKinney improperly injected the substance into her face without securing a full and complete consent after explaining the risks involved.
Bourne says she has suffered serious injuries to her face, pain, suffering, mental anguish, annoyance, inconvenience and substantial expense in seeking treatment. Her husband says he has been deprived of the love, care, affection, advice, services and companionship of his wife while she recovers.
They seek compensatory damages, pre- and post-judgment interest, court costs, attorney fees and other relief.
The Bournes are represented by Lawrence E. Morhous of Brewster Morhous Cameron Caruth Moore Kersey & Stafford PLLC of Bluefield. The case has been assigned to Circuit Judge Warren McGraw.
