Logan County widow sues CitiFinancial Inc., alleging illegal debt collection

LOGAN-- A Logan County widow is suing CitiFinancial Inc, alleging illegal debt collection and misrepresentation.

Rosella McGraw, of Logan County, filed  lawsuit Aug. 21 in Logan Circuit Court, against CitiFinancial Inc., alleging mortgage loan servicing abuse.

According to the complaint, on Oct. 30, 2014, McGraw entered into a settlement with CitiFinancial and began making payments in November for $286.45 once a month  The suit says McGraw continued to make said payments in a timely manner. This was reportedly evidenced by a modification of the deed of trust, which was properly recorded, and which she says the defendants have failed to honor, the suit says.

Since April, the plaintiff alleges the defendants have upped the price to $348 per month and have continued to do so, and have even gone so far as to report her as delinquent to credit agencies, even though she has maintained paying her balance at the fixed amount agreed upon.

The suit says the amount supposed to be owed has been grossly misrepresented by the defendant and reflects these inflated, not agreed-upon amounts.

McGraw seeks civil penalties of $4,750 for each violation of the agreement, attorney fees, court costs and any other damages the court finds just. She is represented by attorney Daniel F. Hedges, of Mountain State Justice Inc. of Charleston.
