GLENVILLE--A Connecticut company is suing a piping company, seeking payment for goods rendered plus interest.
H. Muehlstein & Co., Inc., of Wilton, Conn., filed a lawsuit Aug. 31 in Gilmer Circuit Court against Appalachian Piping Products Inc., of Glenville, alleging breach of contract.
According to the complaint, H. Muehlstein seeks to recover $141,135 and interest from Appalachian Piping for goods rendered in prices set forth in an invoice taken from the company's books and records and provided as evidence by the plaintiff.
The suit says the goods were ordered at an previously agreed upon price that the defendant found fair and reasonable, and which goods were received and accepted by the defendant. Appalachian Piping has paid $10,000 on the account thus far, but still owes the amount previously cited, the lawsuit says.
H. Muehlstein & Co. seeks the amount owed, plus court costs and attorney fees as well as any other additional sums the court finds proper. It is represented by attorney John R. Keating, of Amato Keating & Lessa, of Bethlehem, Pa.
