Bank of Romney says business, two people owe $1.2 million on loan

HAMPSHIRE--A Hampshire County bank is suing two individuals and a small business, seeking to be reimbursed for money lent in a promissory note that has allegedly largely been unpaid.

The Bank of Romney filed a lawsuit Aug. 28 in Hampshire Circuit Court, against Bristol Springs, Charles D. Hogendorp Jr. and Betty J.S. Hogendorp, all of Mount Airy, Md.

According to the complaint, Bristol Springs, a limited liability company, is indebted to The Bank of Romney for $1,222,456.30, the unpaid amount of a commercial promissory note from November 2009 for $1.3 million, which was signed by the Hogendorps on Nov. 11, 2009.

They also signed a personal guaranty agreement the same day, the suit says, agreeing to pay the loaned amount in full by Nov. 11, 2012, at which time they did not, thus defaulting on the loan. 

The Bank of Romney seeks the owed amount in full, plus interest, court costs and attorney fees as accorded by law and seen fit by the courts.  It is represented by attorney Nelson M. Michael, of the Nelson M. Michael firm in Keyser. The case has been assigned to Circuit Judge Charles E. Parsons.
