Wheeling couple sues Wolfe Plumbing & Bath over rear-end collision

WHEELING—An Ohio County couple is suing a home improvement business and its principal on claims of vehicular negligence in an accident when the owner allegedly crashed into the wife's automobile from behind.

Stephani McKitrick and James McKitrick of Wheeling filed a lawsuit against Robert Wolfe and Wolfe Plumbing & Bath LLC of Wheeling in Ohio Circuit Court on Sept. 8, asserting vehicular negligence in September 2013.

The suit states that Stephani was operating her husband’s vehicle on or about Sept. 5, 2013, on the 600 block of Main Street in Wheeling when a motor vehicle owned and operated by the defendant allegedly rear-ended her recklessly and violently.

Claiming serious personal injuries, the plaintiffs charge the defendant with several traffic code violations, including failure to yield the right of way, keep a lookout for other vehicles and observe traffic, control his vehicle, maintain a proper speed, obey a traffic signal, apply his brakes, and keep a sufficient distance from the plaintiff’s vehicle.

According to the complaint, Stephani sustained injuries to her head, neck, back and limbs. The McKitricks claim pain, lost earning capacity, medical expenses, diminished ability to enjoy a normal life, and emotional upset, as well as consortium and property damage.

The plaintiffs seek compensatory damages in excess of the jurisdictional amount, pre- and post-judgment interest, attorneys’ fees, and costs.

The plaintiffs are represented by Ronald Zavolta and Jordan Laird of the Zavolta Law Office in Wheeling. The case has been assigned to Judge Ronald E. Wilson.
