Webster Co. business accuses trucking firm of contract breach

WEBSTER SPRINGS – A Webster County equipment company is suing the owner of a Cowen trucking business, alleging he has not paid the prearranged price of their rental contract.

Leslie Equipment Co. of Cowen filed a lawsuit Aug. 21 in Webster Circuit Court against Jeffrey C. Perrine of J & S Trucking, Inc. (though the case document alleges there is no known business by that name in West Virginia), alleging Perrine failed to pay an arranged charge resulting in breach of contract from their 2014 rental agreement.

According to the complaint, Perrine has accepted said use of his rented materials from Leslie Equipment Co. although he has not paid in full, if any, of the $10,007.31 from the Nov. 30, 2014, invoice.

Leslie Equipment Co. seeks to recover the initial rental sum of $10,007.31, as well as interest at the rate of  percent per annum to the past due balance from Dec. 30, 2014, to the day of the court judgment. It is represented by attorney John R. Keating of Amato Keating and Lessa in Bethlehem, Pa. The case has been assigned to Circuit Judge Jack Alsop.
