PRINCETON--A Mercer County woman is suing Lowe's Homes Centers, alleging it failed to properly install and replace certain materials in her home.
Fonda Morgan filed a lawsuit in Mercer Circuit Court against Lowe's Home Centers, alleging breach of contract, breach of implied warranty, breach of express warranty and negligence.
In August 2014, the complaint states, Morgan entered into a contract with the defendant for the installation of replacement windows and siding, soffit and facia in her home in Bluefield. The suit says Morgan paid approximately $6,900 for the replacement windows and installation and approximately $6,100 for the siding, soffit, and facia installation.
The lawsuit alleges Loew's breached its contract and was negligent by failing to appropriately install the windows, siding, soffit and facia in her home. As a result, she has suffered damages and will be required to incur expenses to replace the materials, the suit says.
Morgan seeks a judgment in an amount necessary for the removal of the materials and for the purchase and installation of replacement materials, plus court costs and attorney fees. She is represented by attorney C. William Davis of Richardson & Davis in Bluefield.
