Ohio couple sues Hutchinson Electric, employee over vehicle collision

WHEELING -- An Ohio husband and wife are suing an electrical contracting company and one of its employees, alleging negligence in a vehicle collision in Valley Grove.

Brittany A. Baldwin and Jonathan A. Baldwin, of Belmont County, Ohio, individually and as guardian, father, and next of friend of minors Kaili P. Baldwin and Natili S. Baldwin, filed a complaint in Ohio Circuit Court against Joel A. Mahoney and Hutchinson Electric, alleging negligence.

According to the complaint, on Aug. 29, 2013, Jonathan Baldwin was operating a 2012 Chevrolet Malibu eastbound on Interstate Highway 70 in Valley Grove, when Mahoney, operating a 2007 GMC Savana Cargo Van owned by Hutchinson Electric, rear-ended Baldwin's vehicle.

The suit says Mahoney was negligent in failing to keep a proper lookout, failing to stop, disregarding a traffic control device, speeding, following too closely and failing to maintain control. As a result, the lawsuit states, Jonathan Baldwin suffered injuries to his head, neck, jaw, shoulders, back, chest, arms, and legs, for which he has incurred medical expenses.

The complaint further alleges the other plaintiffs have suffered a loss of love, society, comfort, companionship and services of their father and husband.

The Baldwins seek compensatory and general damages, plus attorney fees and court costs. They are represented by attorney Shane M. Mallett of Mallett Law Offices in Wheeling.
