Agency claims medical practice committed Medicaid fraud

CHARLESTON– A West Virginia public agency is seeking compensation from a medical practice that they allege committed fraud.

The West Virginia Medicaid Fraud Control Unit of Charleston filed suit on Aug. 14 in Kanawha Circuit Court against Mountaineer Family Medicine Inc. and Dr. Mohamad S. Kalou, individually and in his capacity as president of Mountaineer Family Medicine Inc.

The plaintiff alleges that the defendants committed fraud between Jan. 1, 2011, and May 15, 2012, by seeking higher payments than which they were entitled and knowing they were doing so. The plaintiff seeks payment in the amount of three times the amount of over payment, totaling $821,895.21, attorney fees and court costs, and any and all other relief as judged proper by the court, according to the complaint. Plaintiff demands a trial by jury.

The plaintiff is being represented by Richelle K. Garlow of West Virginia Medicaid Fraud Control Unit of Charleston. The case has been assigned to Circuit Judge Carrie L. Webster.
