Customer charges Dollar General with ignoring her complaint

RIPLEY–A Jackson County resident is suing a retail business on claims of negligence stemming from a slip-and-fall incident, coupled with allegations of failure to address her initial complaint.

Dorothy Cook of Ripley filed charges against Dolgencorp LLC, doing business as Dollar General of Goodlettsville, Tenn., in Jackson Circuit Court Sept. 17, asserting premises negligence in September 2014.

The suit states that when Cook was a customer at the Dollar General at 3052 Charleston Road, Ripley on Sept. 8, 2014, she slipped on a substance on the store’s floor and fell, sustaining injuries to her left hand and fingers, back and left leg.

The lawsuit states that Cook documented her fall, reported a claim to the store, contacted corporate headquarters as per the local store’s instructions, and obtained a claim number. Cook avers that despite having followed directions, her claim “was flatly denied.”

According to the complaint, the plaintiff endured pain, suffering, lost wages, annoyance, aggravation, and anguish, and expects symptoms to continue in the future.

The plaintiff seeks general and special damages for the defendant’s alleged negligence plus pre-judgment interest, punitive damages, attorney’s fees, and costs.

Cook is represented by Kevin Davis of Charleston. The case has been assigned to Judge David W. Nibert.
