BECKLEY – A couple has filed suit against a real estate business over claims that the business tried to void the real estate agreement after it was signed.
Charles and Eledda Bennet filed suit Sept. 17 in Raleigh Circuit Court against Real Estate Biz LLC.
According to the suit, the Bennets and Real Estate Biz entered a mutually negotiated and legally binding real estate purchase agreement June 18 for a portion of Lot 90 at Ronald Street in Shady Spring. The price was set at $4,291.35, according to the suit.
However, the suit claims, seven days after the agreement was signed, Real Estate Biz sent an email to the plaintiff's counsel trying to void the purchase. The claim states that Real Estate Biz had "unreasonable expectations with regard to closing time that were not a portion of the mutually agreed upon real estate purchase agreement." The Bennets have reached out to Real Estate Biz, but no message has been returned, according to the suit.
The Bennets demand a remedy of specific performance be ordered in addition to judgment against Real Estate Biz for the sum of $1,000 attorney and court fees. They are represented by Benjamin N. Hatfield of The Law Offices of Benjamin N. Hatfield in Beckley.
