Caution

BECKLEY – A Beckley woman is suing a local discount store after she claims to have fallen and was injured on the store’s property.

Anna Mae Fox filed suit Sept. 16 in Raleigh Circuit Court against Ollie’s Bargain Outlet, claiming negligence.

According to the suit, Fox was shipping at Ollie’s Beckley location on March 8, 2014, when she stepped on a piece of fruit, causing her to slip and fall, suffering severe injuries.

The lawsuit claims Ollie’s breached its duty by permitting a slippery, hazardous walkway inside the store.

Fox seeks compensatory damages for her medical expenses, pain and suffering, physical limitations, diminished capacity to enjoy life, annoyance and inconvenience and other consequences and damages associated with her injuries. She asks for pre- and post-judgment interest, attorneys’ fees and any further relief allowed by the court.

Fox is represented by Melissa R. Lyons, Robert D. Cline Jr. and Brian E. Bigelow of Farmer, Cline & Campbell of Beckley.

Raleigh Circuit Court civil action number 15-C-824-K.
