Quality Magnetite sues mining company over allegations of unpaid services

BECKLEY – A West Virgina company is suing a client over claims that thousands of dollars' worth of payments for services provided were never received.

Quality Magnetite LLC filed a lawsuit on Sept. 10 in Raleigh Circuit Court against Nufac Mining Co., demanding payment for three past due invoices.

According to the complaint, Quality Magnetite, located in Cabell County, provides services such as the delivery of magnetite, a type of iron oxide. The plaintiff, on three separate occasions from October to December 2013, delivered more than 77 tons of 90-grade magnetite to Nufac Mining Co. The plaintiff claims that the monetary worth of the magnetite delivered equals up to $22,501.52. The plaintiff claims that the defendant neglected to pay for the goods provided.

Quality Magnetite is seeking $22,501.52, pre-judgment and post-judgment interest, as well as court costs. It is represented by Matthew J. Perry of Lamp, Bartram, Levy, Trautwein & Perry PLLC in Huntington. The case has been assigned to Judge H. L. Kirkpatrick III.
