Ohio trucking company seeks damages after Route 219 accident

KINGWOOD–An Ohio-based trucking company is suing a Maryland insurance business on claims of property damage in connection with a 2014 motor vehicle accident on a Preston County highway.

Hartford Fire Insurance Co., as subrogee of Custom Assembly Inc. of Haviland, Ohio, filed a lawsuit against Rigidply Rafters Inc. of Oakland, Md., and its employee Travis Bender in Preston Circuit Court on Sept. 17, asserting vehicular negligence in December 2014 when Bender’s vehicle allegedly sideswiped the plaintiff’s rig.

The suit states that Bender, operating a tractor-trailer owned by Rigidply, collided with a rig belonging to Custom Assembly while traveling northbound on U.S. Route 219 near Aurora in Preston County on Dec. 17, 2014.

According to the complaint, Bender, who subsequently received a traffic citation, failed to keep his vehicle in the proper travel lane and drove on the wrong side of the road.

The lawsuit states that the plaintiff, whose employee allegedly operated its vehicle safely during the incident, sustained property damage in the amount of $914.14.

Custom Assembly seeks compensation for economic losses along with associated expenses, interest, attorney's fees, and costs.

The plaintiff is represented by Timothy Montgomery of Pion, Nerone, Girman, Winslow & Smith in Pittsburgh. The case has been assigned to Judge Lawrence S. Miller Jr.
