WINFIELD–An Amite, La. husband and wife are suing a truck driver and his employers over a hit-and-run vehicle collision.
Leontine Foster and Douglas Foster filed a complaint Sept. 15 in Putnam Circuit Court against Anthony Benton, Maverick USA, and Maverick Transportation, alleging negligence.
On Oct. 8, 2014, the complaint states, Leontine Foster was inside her 2007 Peterbuilt tractor-trailer, parked at a Pilot Truck Stop in Nitro, when Benton, operating a tractor-trailer owned by the defendants, struck Foster's vehicle and left the scene. Foster was violently tossed about the cab at the time of the collision, according to the complaint.
The complaint states that Benton was negligent in failing to maintain control of his vehicle and failing to keep a proper lookout and Maverick USA and Maverick Transportation were responsible for Benton's actions, and that they were negligent in failing to properly train and/or supervise him.
As a result, Leontine Foster sustained severe and permanent injuries, pain and suffering, mental anguish, inconvenience and annoyance, loss of income and benefits, reduction of gainful employment and earning capacity, loss of enjoyment of life, and medical expenses.
The plaintiffs seek compensatory damages, punitive damages, interests, costs, and attorney fees. They are represented by Douglas A. Spencer and C. Michael Bee of Hill Peterson Carper Bee & Deitzler in Charleston. The case has been assigned to Circuit Judge Phillip M. Stowers.
