CHARLESTON – A Kanawha County woman is suing over injuries she sustained in a South Charleston park.
Ella M. White filed a complaint Sept. 16 in Kanawha Circuit Court against Cornerstone Family Services of West Virginia, doing business as Sunset Memorial Park - South Charleston, alleging negligence.
On May 25, the complaint states, White was stepping out of her vehicle at defendant-owned Sunset Memorial Park in South Charleston, when she stepped in a hole that was covered with grass, causing her to fall.
The complaint states the defendant was negligent in failing to properly maintain the property and exercise due care for the safety of those lawfully on the property.
As a result, White sustained injuries to her left knee and both legs, pain and suffering, mental anguish and emotional distress, loss of ability to enjoy life, and medical expenses.
White seeks monetary compensation, plus interests, attorney fees, and court costs. She is represented by D. Scott Tyree of Tyree Embree & Associates in Hurricane. The case has been assigned to Circuit Judge Louis H. Bloom.
