Harvey's Inc. asks court to enforce original deed

BECKLEY – A Raleigh County business has filed a petition for declaratory judgment in relation to a property dispute.

Harvey’s Inc. filed a lawsuit Sept. 3 in Raleigh Circuit Court against Schewel-Charles Town (SCT) and Donald D. Hodson.

According to court documents, Harvey’s owns property adjacent to the land where SCT operates a furniture store. The suit claims Harvey’s is not bound by the restrictive covenants in an agreement between SCT and the adjacent property’s former owner, Beckley Acme Market Inc., and is asking the court to void the restrictive covenants contained in this agreement.

Harvey’s seeks the court’s ruling that the agreement in question is voided and that the covenants, parking and development plan in the original deeds are enforceable. It is represented by attorney James R. Sheatsley of Gorman, Sheatsley & Co. in Beckley.
