NEW CUMBERLAND–A Hancock County resident is suing a New Jersey-based insurance business doing business in West Virginia, claiming of breach of contractual obligation for coverage of an automobile accident.
Ralph Gorrell of Weirton filed a lawsuit against AIG Property Casualty Co., also known as AIG Property Casualty Insurance Co. Inc., of Berkeley Heights, N.J. and maintaining a local office in Charleston, in Hancock Circuit Court on Sept. 16, claiming liability in an October 2014 collision involving an unknown and therefore “uninsured” party.
The suit states that the plaintiff’s automobile was “recklessly sideswiped and wrecked” by John Doe, an unknown motorist, while Gorrell was traveling eastbound on Route 22 in Brooke County on Oct. 22, 2014.
According to the complaint, the plaintiff sustained physical injuries, pain and suffering, mental anguish, loss of capacity to enjoy life, and medical expenses.
Gorrell seeks compensatory damages for economic and non-economic losses, punitive damages, pre- and post-judgment interest, attorneys’ fees, and court costs.
The plaintiff is represented by Vincent Gurrera of Gurrera Law Offices in Weirton. The case has been assigned to Judge Jason A. Cuomo.
