LOGAN – A foot and ankle surgeon is suing her employer alleging she was unlawfully terminated from her job after returning from a medical leave.
Dr. Jamie L. Hall-Jasper filed suit against Logan General Hospital LLC, doing business as Logan Regional Medical Center, Daryl Taylor, Timothy Matney and Kristy Proffit on June 5 in Logan Circuit Court, citing violations of the West Virginia Human Rights Act and tort of outrage/intentional infliction of emotional distress.
According to the complaint, Hall-Jasper began employment with the hospital in July 2013. The plaintiff alleges that upon her return to work following a stomach ailment that required surgery in January and a substantial hospital stay, her work was unfairly scrutinized and she was pressured into treating more patients.
On Aug. 19, 2014, the complaint states, she was unexpectedly and publicly advised she would be required to undergo a drug test and her clinic would be closed pending the results. On Aug. 29, 2014, despite successfully passing the drug test, she was terminated. The plaintiff claims she was never disciplined and that her termination was unlawful. Furthermore, the plaintiff alleges that her treatment by defendants was intentionally outrageous and intolerable.
The plaintiff is seeking compensatory damages for back pay and future pay, punitive damages, attorney fees and costs of litigation.
