Estate claims McElroy Mine negligent in man's death

MOUNDSVILLE – The estate of a man killed in a 2013 mining accident recently sued the owners of the Marshall County coal mine and all related entities alleging negligence.

The estate of Roger King filed suit against McElroy Mine and numerous other companies in the Circuit Court of Marshall, West Virginia on Oct. 2. King died in the mine on Oct. 4, 2013 after being struck in the head by a snatch block while the defendants were installing a longwell system.

King's estate alleges that the defendants failed to keep the area safe, failed to inspect the equipment and failed to train the deceased prior to the fatal incident.

The plaintiff seeks unspecified damages, plus attorney fees, punitive damages and costs. King's estate is represented by Marvin W. Masters of The Masters Law Firm in Charleston. Judge David Hummel Jr. is presiding.
