Woman blames Tri-State Transit Authority for injuries from boarding bus

WAYNE – A woman is suing Tri-State Transit Authority after she claims she sustained injuries while attempting to board one of its vehicles.

On Dec. 29, 2008, Janet Baisi was attempting to board a van in Kenova that was owned and operated by TTA, according to a complaint filed in Wayne Circuit Court.

Baisi claims while he was boarding the van, an unknown hazard caused her to trip and fall and sustain serious injuries, including a punctured lung.

TTA owed a duty to Baisi to operate and maintain control of the van in question in a reasonable and safe manner, according to the suit.

Baisi claims the defendant violated its duty owed to her by failing to operate the van in a safe manner and failing to maintain the van in question in proper working order.

The defendant breached its duty owed to her by operating and maintaining the van slightly negligently, carelessly, willfully, wantonly, recklessly and maliciously in breach of the applicable standard of care, according to the suit.

Baisi claims the breach of duty of negligence cased her physical pain; mental pain, anguish and suffering; loss of service, protection, care and assistance; and quality of life; extreme emotional distress; and medical expenses.

Baisi is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Mark F. Underwood of Underwood Law Offices in Huntington.

The case is assigned to Circuit Judge James H. Young.
