Man blames Fresenius Medical Care for father's death

HUNTINGTON - A man is suing Fresenius Medical Care after he claims its negligence caused his father's death.

Huntington Internal Medicine Group, Dr. Michael Collins, Jessica Durst, JoAnne Caudill and Stacy Cook were also named as defendants in the suit.

On July 13, 2013, John E. Bourdelais was undergoing dialysis treatment under the care of the defendants, according to a complaint filed Oct. 5 in Cabell Circuit Court.

John M. Bourdelais claims the defendants seriously and permanently injured his father, which led to his premature death.

The defendants breached the applicable standard of care by its failure to properly train, supervise and monitor the medical, nursing and technical staff involved with his father's care, according to the suit.

John M. Bourdelais claims during his father's treatment, they failed to properly aid, assist and resuscitate him and breached the standard of care, resulting in life-threatening injuries, including hemorrhagic shock, cardiopulmonary arrest, bilateral pleural effusions, cardiac arrhythmias, hypovolemic arrest, traumatic hemothorax and multiple fractured ribs secondary to resuscitation.

The defendants' actions shortened John E. Bourdelais' life by two years, according to the suit.

John M. Bourdelais is seeking compensatory and punitive damages. He is being represented by Roy D. Baker Jr. of Baker Law Offices.

The case is assigned to Circuit Judge Christopher D. Chiles.
