WHEELING – An Ohio County husband and wife are suing a construction company for allegedly not completing construction of a garage and barn near their home.
Gabe Frangos and Jennifer Frangos filed a lawsuit Oct. 13 in Ohio Circuit Court against Sandow Development, alleging breach of contract, negligence, violations of the West Virginia legislative rules and the West Virginia Consumer Protection Act, and violations of the Magnuson-Moss Warranty Act.
On Sept. 10, 2014, the suit states, the plaintiffs entered into a construction contract with Sandow to build a combination garage addition and barn near their home at 96 Woodheim Farms in Wheeling. The parties agreed on a total contract cost of $94,679. Sandow agreed to commence construction on Sept. 26, 2014, and to complete the work no later than Dec. 17, 2014.
As of May 29, the suit states, the project was still incomplete. The plaintiffs paid $69,000 toward the contract amount to Sandow, but did not pay the rest because the metal roof was not properly installed and the project was not complete.
The suit states the work done by Sandow did not meet industry standards, and workers repeatedly failed to appear at the work site.
The plaintiffs were forced to hire new contractors and construction workers, pay additional boarding fees for their horses, and suffer loss of use, aggravation, and inconvenience.
The plaintiffs seek monetary relief for all their damages, plus attorney fees and costs.
The plaintiffs are represented by Frank X. Duff of the Wheeling law firm of Schrader Byrd & Companion. The case has been assigned to Circuit Judge Ronald E. Wilson.
