Driver, U.S. XPress face suit following Wheeling accident

WHEELING – An Ohio County woman is suing a Tennessee trucking company and one of its drivers over injuries she sustained in a vehicle collision.

Christi Clayton filed a lawsuit on Oct. 13 in the Ohio Circuit Court against Ben Eini and U.S. XPress, Inc., alleging negligence.

On Oct. 26, 2013, the suit states, Clayton was a passenger in a vehicle driven by Steven Michael, who was attempting to make a lefthand turn from Mt. DeChantal Road onto U.S. Route 40 (National Road) in Wheeling.

At the same time, Eini, operating a 2014 International Prostrate tractor trailer truck in the lane next to Michael, was also attempting to make a lefthand turn on the same road, but he allegedly took up both lanes, causing his truck to collide with Michael's vehicle.

Michael's vehicle was then allegedly violently pushed off the roadway and onto the curb. The suit alleges Eini, operating in the scope of his employment with U.S. XPress, was negligent in failing to maintain control of his vehicle, failing to maintain proper lookout, failing to yield the right-of-way, failing to remain in the proper lane, and other negligent acts or omissions.

As a result, Clayton allegedly sustained injuries to her head, brain, neck, shoulder, arm, hand, fingers and back, for which she has incurred medical expenses in excess of $36,000.

Clayton seeks a judgment to adequately compensate for her injuries and losses, plus attorney fees and interests. She is being represented by Gregory A. Gellner of the Wheeling law firm of Gellner Law Offices. The case has been assigned to Circuit Judge Ronald E. Wilson.
