NEW CUMBERLAND – A Weirton husband and wife are suing a motorsports retailer over claims it never delivered a scooter they ordered.
John Wilson and Bella Wilson filed a lawsuit July 21 in Hancock Circuit Court against Motorsports Depot of Chino, Calif. and John Does, alleging breach of contract, unjust enrichment and fraud.
On Nov. 8, 2014, the suit states, the Wilsons ordered a scooter from Motorsports Depot. They paid $2,900 for the vehicle and its delivery to their residence.
The Wilsons were advised the scooter would be delivered to their house on Dec. 16, 2014, but, as of this suit's date of filing, the scooter had not yet been delivered. The suit states the scooter was delivered to another family or location in Florida.
The Wilsons have requested a full refund or delivery of the vehicle but have been refused. Instead, the suit states, Motorsports Depot has decided it will give the Wilsons either a vehicle of lesser value or a refund of only $862.
The Wilsons seek compensatory and punitive damages, plus attorney fees, costs, expenses and interest.
The plaintiffs are represented by Vincent S. Guerra of the Weirton law firm of Guerra Law Offices. The case has been assigned to Circuit Judge David J. Sims.
