MOUNDSVILLE – A Moundsville couple is suing a car manufacturer over allegedly not repairing a coolant smell in their new vehicle.
Joseph and Alicia Straight filed suit against FCA US LLC, doing business in Charleston, on Oct. 5 in Marshall Circuit Court, citing violations of the West Virginia New Motor Vehicle Warranties Law and the Magnuson-Moss Warranty Improvement Act.
According to the complaint, on June 23, 2014, the plaintiffs purchased a new 2014 Dodge Journey at a cost of $35,169.52, which included warranties. They reportedly had the vehicle serviced by authorized dealers on four different occasions from December 2014 to April in unsuccessful attempts to remove a coolant smell. The complaint states that the vehicle's use, safety and value are "substantially impaired by the nonconformities."
The plaintiffs seek unspecified financial damages, plus penalties and costs.
