Man claims Erie Insurance Group owes him compensation following Bluefield collision

PRINCETON – A man is suing an insurance company to cover injuries he sustained in a vehicle collision.

Jeffrey Livingston filed a lawsuit June 4 in Mercer Circuit Court against Erie Insurance Group, alleging the company is liable to pay him compensatory damages.

On Dec. 27, 2013, the suit states, Livingston was a passenger in a vehicle being driven by Ronald Mitchem on Thorn Street in Bluefield, when their vehicle was suddenly rear-ended by a vehicle being driven by Gary Heldreth.

The wreck, which the suit alleges was the fault of Heldreth, caused significant injuries to Livingston, including a disc lesion in his lumbar spine and a significant displaced lateral malleolus ankle fracture.

Mitchem's vehicle was insured by Erie, and Heldreth's vehicle was insured by GEICO.

Livingston claims Erie is liable to him for underinsured coverage of $100,000 because he was injured by the actions of an underinsured motorist, and because the compensation he received from the at-fault driver was substantially lower than the compensation he claims he's entitled to given the severity of his injuries.

Livingston seeks compensatory damages, plus interests, attorney fees, and costs of the suit.

Livingston is being represented by William Flanigan of Sanders, Austin, Flanigan, & Prudich in Princeton. The case has been assigned to Circuit Judge William J. Sadler.
