Man involved in Cheat Lake boat crash sues owner, driver for injuries

MORGANTOWN – A man who was involved in a boat crash over Memorial Day weekend is suing the owner and driver of the boat for his injuries.

On May 25, Jacob Alexander was an occupant in a 2005 Malibu Wakesetter boat that Brandon Solomon was operating and Steven B. Solomon owned, according to a complaint filed Nov. 16 in Monongalia Circuit Court.

Alexander claims Brandon Solomon was operating the boat at excessive speeds and was under the influence of drugs and alcohol.

While operating the boat, Brandon Solomon negligently and recklessly fell from behind the controls of the boat, lost control of the boat and crashed the boat into an embankment off the eastern shore line of Cheat Lake, according to the suit.

Alexander claims as a result of the crash, he suffered severe and permanent injuries.

Brandon Solomon operated the boat with Steven Solomon’s permission and Steven Solomon was negligent in entrusting Brandon Solomon with the boat, according to the suit.

Alexander claims the negligent and unlawful actions of Brandon Solomon proximately caused the crash, including operating the boat recklessly; failing to maintain control of the boat; operating the boat under the influence of alcohol; operating the boat while he was under the influence of drugs; operating the boat in total disregard for the safety of persons in or around it; and failing to take appropriate action to avoid the crash.

Alexander is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Harry G. Deitzler of Hill, Peterson, Carper, Bee & Deitzler PLLC.

The boat crash injured a total of 12 passengers.
