Wheeling Island Gaming accused of serving liquor that caused car wreck

WHEELING – A Belmont County, Ohio, man injured in car crash in 2013 says a racetrack in Wheeling overserved the driver who struck his vehicle in a head-on collision.

Jacob A. Flading filed a lawsuit Oct. 8 in Ohio Circuit Court against Wheeling Island Gaming Inc., WDRA Food Service Inc., Delaware North Cos. Gaming & Entertainment Inc. and Delaware North Cos. Inc.

According to the complaint, Vance Mark Taft II had consumed alcohol served to him by the defendants on Oct. 17, 2013, when he drove his Chevy pickup truck head on into plaintiff Jacob A. Flading’s Dodge van on Route 250 in Belmont County. The suit says Taft had a blood alcohol level of 0.182. Jacob A. Flading claims he suffered multiple injuries, including a fractured leg and lacerated spleen and liver, requiring several surgeries and costly ongoing medical care.

Flading seeks compensatory and punitive damages to be determined by a jury. He is being represented by Louis H. Khourey and Teena Y. Miller of the Moundsville law firm Gold, Khourey & Turak. Circuit Judge David J. Sims has been assigned to the case.
