Woman blames Cabell Huntington, Marshall for injuries from hysterectomy

HUNTINGTON – A woman is suing Cabell Huntington Hospital and Marshall Health after she claims she was injured while in their care.

Drs. Amanda N. Pauley and Kelly F. Cummings were also named as defendants in the suit.

On July 12, 2013, Carol Rice was a patient of the defendants and had a hysterectomy performed, according to a complaint filed Nov. 5 in Cabell Circuit Court.

Rice claims the defendants violated the standard of care by failing to adhere to or have in place, a procedure or system that directed medical professionals performing the same or similar procedures as what was performed on her to perform a post-operative cystoscopy prior to closing to observe for bilateral uretic patency.

The defendants failed to diagnose bilateral uretic patency in a timely manner causing permanent injury to Rice, according to the suit.

Rice claims the defendants deviations from the standard of care were the proximate and direct cause of physical injuries she sustained.

Because of the carelessness and negligence of the defendants, Rice was caused pain, embarrassment, suffering, physical injury, permanent scarring, physical pain and inconvenience, according to the suit.

Rice is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Timothy P. Lupardus of Lupardus Law Office.

The case is assigned to Circuit Judge Christopher D. Chiles.
