Ohio man brings suit against Travelers to recover benefits

MOUNDSVILLE – An Ohio man is suing an insurance company to claim benefits for injuries he sustained in an automobile collision.

Melvin L. Green of Bellaire filed a lawsuit June 5 in Marshall Circuit Court against Travelers Indemnity Co. of Connecticut.

On Oct. 23, 2013, the suit states, Green was driving northbound on Route 2 in Marshall County in the scope of his employment with Kenneth E. Parsons Consulting, doing business as Ricochet, when his vehicle was struck by a vehicle driven by Anthony J. Hadom.

The suit states Hadom was negligent in failing to maintain control, failing to maintain proper lookout, and failing to yield to the right-of-way.

As a result, Green sustained injuries to his neck, left knee, and left hip, for which he underwent lumbar spine surgery and has incurred medical expenses.

The defendant issued an automobile insurance policy to Ricochet that was in effect on the date of said accident with injury coverage benefits of $1 million per accident, the complaint states. The suit states Green made timely claims for all benefits available to him under the policy.

Green seeks a judgment for all underinsured motorist coverage benefits due and owing pursuant to the policy, together with interests. He is seeking damages of more than $50,000.

He is represented by attorneys Scott S. Blass and John E. Artimez Jr. of Bordas & Bordas in Wheeling. The case has been assigned to Circuit Judge David W. Hummel Jr.
