Marshall Co. couple claims Blue Racer plant causes too much pollution

MOUNDSVILLE – A Marshall County husband and wife are suing a midstream energy company after an explosion at its plant allegedly created pollution and emissions around their home and property.

Delbert Wade and Arwana Wade of Kent filed a lawsuit in Marshall Circuit Court against Blue Racer Midstream, alleging negligence.

On Sept. 21, 2013, the suit states, a fire at the Blue Racer Plant caused an explosion, which increased the constant and continuous amount of fumes, odors, dust, dirt, debris, smoke, pollution, and emissions on the Wades' property and home near the plant.

The suit states the defendant's negligent actions have caused the plaintiffs apprehension and risk of another explosion, as well as exposure to dangerous and toxic substances.

As a result, the plaintiffs have suffered a diminution of property value, interference with private use and quiet enjoyment of their land, and emotional and mental anguish.

The Wades seek compensatory, general, and punitive damages, plus interests, attorney fees and costs of the suit.

They are represented by attorneys James G. Bordas Jr. and Jeremy M. McGraw of Bordas & Bordas in Wheeling. The case has been assigned to Circuit Judge Mark Karl.
