LOGAN – Two Logan County women are suing a medical practice over claims it failed to pay its laid off employees and employees who quit in a timely manner.
Cynthia Damron and Amy Vance, individually and for all others similarly situated, filed a class action lawsuit in Logan Circuit Court against University Physicians and Surgeons, alleging violations of the West Virginia Wage Payment and Collection Act.
The defendant laid off Damron on April 29, and Vance quit her employment with the defendant on Feb. 27.
The suit states the defendant did not pay their wages owed in a timely manner, and that they failed to pay other similarly situated employees in a timely manner.
The plaintiffs and others in the class seek to recover damages including all remedies, benefits, and general and compensatory damages, plus interests, injunctive relief, and attorney fees and costs.
Damron and Vance are represented by attorneys Todd S. Bailess and Joy B. Mega of Bailess Law in Charleston. The case was assigned to Circuit Judge Roger L. Perry.
