Man alleges Transworld engaged in illegal debt collection

LOGAN – A Logan County man is suing a collection agency over claims of abusive or unconscionable tactics to collect an alleged debt.

James Carter filed a lawsuit in Logan Circuit Court against Transworld Systems, alleging violations to the West Virginia Consumer Credit and Protection Act (WVCCPA).

Carter had retained counsel to represent his interest in connection with a motor vehicle accident that occurred on Oct. 1, 2013. On Aug. 13, 2014, the suit states, Carter negotiated a full and final payment of the debt incurred to the creditor and a check was written on Sept. 5, 2014.

According to the suit, Transworld still attempted to collect.

The suit states Transworld violated the WVCCPA by attempting to collect on a previous indebtedness that had been paid in full or in excess of what was actually owed by misrepresenting amounts claimed due on numerous occasions, and by communicating with Carter after he had attorney representation and the attorney's name and address were known.

As a result, Carter has been annoyed, inconvenienced, harassed, harangued, and otherwise caused indignation and distress, the suit states.

Carter seeks actual, statutory, general, and punitive damages, plus injunctive relief and costs of the litigation.

Carter is represented by attorney Steven S. Wolfe of Wolfe Law Office in Logan. The case was assigned to Circuit Judge Roger L. Perry.
