Son claims father’s death at Glenwood Park a result of negligence

PRINCETON – A Mercer County man has filed a suit against Glenwood Park nursing home, claiming his 76-year-old father developed infections and dehydrations, leading to his death.

Ernest Bailey Jr. filed against Glenwood Park Inc. and Daniel W. Farley in Mercer Circuit Court, citing negligence, malice, fraud, premises liability and violation of the West Virginia Consumer Credit and Protection Act.

Ernest Bailey Jr. says his father, Ernest Bailey, lived at Glenwood for approximately one year. According to the complaint, the elder Bailey suffered from infections and dehydration and was inadequately supervised to prevent falls. The suit says these injuries, which resulted from the defendant’s alleged negligence, ultimately led to Bailey’s death on March 14.

Bailey Jr. seeks a jury trial and punitive and compensatory damages, plus litigation costs. He is represented by attorneys James B. McHugh, Michael J. Fuller Jr., Kendra R. Fokakis and D. Bryant Chaffin of the Hattiesburg, Mississippi law firm the McHugh Fuller Law Group. The case has been assigned to Circuit Judge Omar J. Aboulhosn.
