SDW Electric sued for allegedly unpaid debts

MOOREFIELD – Lighting company Capital Tristate says it lent an electrical company some $13,000 worth of merchandise but has been unable to collect for any of it.

Capital Tristate filed May 29 against SDW Electric in Hardy Circuit Court, citing breach of contract.

According to the complaint, Capital Lighting & Supply Inc., doing business as Capital Tristate, entered into a contract with SDW Electric to provide materials, parts and supplies on credit, with an 18 percent annual interest rate. After SDW had allegedly purchased $13,445.49 without paying for it as of March 2013, Capital Tristate decline to issue further credit and has made several attempts to collect the debt.

Capital Tristate seeks damages for the unpaid merchandise, plus interest, totaling $18,517.44. The plaintiff also seeks restitution for other damages resulting from the unpaid debt, as well as litigation costs. It is represented by Scott Depot attorney Mary K. Prim of Mary K. Prim PLLC. Judge H. Charles Carl III has been assigned to the case.
