Six employees accuse Mason BOE of wage underpayment

POINT PLEASANT – Six West Virginia workers say the Mason County Board of Education illegally cut their pay.

Karen Shull, Kelly McCarty, Velva Matheny, Tammy Westfall, Karen Wamsley and Vicki Watterson filed against the board on July 11 in Mason Circuit Court, citing violation of the West Virginia Wage Payment and Collection Act.

According to the complaint, the board of education increased the working hours of the plaintiffs from seven to eight hours each day and discontinued paying them for working more than 35 hours per week. The suit says the wages were cut for the 2011-2012 and 2012-2013 contract years.

The plaintiffs seek a jury trial and treble damages for the unpaid wages. They are represented by attorney Walt Auvil of the Parkersburg law firm Rusen & Auvil. Circuit Judge David W. Nibert is assigned to the case.
