Ohio County man claims ex-employer failed to pay him in a timely manner

WHEELING – An Ohio County man is suing his former employer alleging wages were not paid to him in a timely fashion following his termination from the company.

James Mortakis filed a lawsuit on Dec. 27 in Ohio Circuit Court against O’Brien’s Rent-All and Sales, Inc. claiming a violation of the West Virginia Wage Payment and Collection Act.

Mortakis, who was employed by O’Brien’s from approximately June 2008 through Jan. 23, when he was fired. He claims, per the law, that an ex-employee should be paid his full wages no later than the next payday or four business days – whichever comes first.

Mortakis claims that his former employer failed to pay his wages in full by Jan. 28, as required by law, and is therefore liable for liquidated damages under the West Virginia Wage Payment and Collection Act.

Mortakis is being represented by Wray V. Voegelin of Shapell & Voegelin, L.C. of Wheeling. The case has been assigned to Circuit Court Judge James P. Mazzone.
