NEW CUMBERLAND – A man is suing HLC Holdings Inc. after he claims he was injured while on its premises.
HLC Holding is doing business as Homer Laughlin China Co. The company, which is based in Newell, is best known for its Fiesta line of dinnerware.
On Dec. 9, 2013, Albert Baumgartner was a patron at the defendant’s establishment, according to a complaint filed in Hancock Circuit Court.
Baumgartner claims while there, he was caused to fall due to dangerous and hazardous conditions on the premises.
The plaintiff was caused to fall due to a defect in the pavement in the shipping and receiving area of the premises as a result of the defendant’s negligent, careless and/or reckless conduct, according to the suit.
Baumgartner claims the defendant failed to conduct a reasonable inspection of the premises; failed to maintain its premises in a reasonably safe condition; failed to correct the dangerous and/or hazardous condition on the premises; and failed to warn him and other invitees of the dangerous conditions.
As a direct and proximate result of the negligent, careless and/or reckless conduct, Baumgartner suffered severe and disabling personal injuries and was forced to seek medical treatment and incur medical expenses.
Baumgartner is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Michael G. Simon and Kevin M. Pearl of Frankovitch, Anetakis, Colantonio & Simon.
