BECKLEY – A Fayette County attorney is suing Advantage Boats Inc. after he claims he unknowingly purchased a defective and damaged boat.
On Aug. 25, Anthony M. Salvatore phoned the defendant’s dealership with an interest in purchasing a reliable and durable motor boat, according to a complaint filed in Raleigh Circuit Court. Salvatore is an attorney with Hewitt & Salvatore PLLC based in Fayetteville.
Salvatore claims the sales staff directed him toward a 1995 Concord Speed Boat and, in the course of looking at the boat, he was told by the salesman that the boat was mechanically sound and reliable.
After the purchase of the boat, Salvatore began to experience problems with the boat and discovered that the boat had sustained major damage, according to the suit.
Salvatore claims he was not interested in purchasing a boat with prior problems and made such interest known to the defendant’s agent prior to the purchase of the boat by asking if it had been wrecked or damaged.
The plaintiff purchased the boat after the salesman assured him that nothing was wrong with the boat, according to the suit.
Salvatore claims the boat has not been involved in any accidents since he purchased it and, upon discovering that the boat had a blown engine, he called the defendant and was told the boat had no warranty.
As a result, Salvatore has been deprived the benefit of bargain, was deceived into purchasing a boat worth far less than the amount paid and whose resale value is greatly diminished and has been unable to recover funds paid for the boat, according to the suit.
Salvatore claims he has had to pay funds in an effort to complete the repairs made after the undisclosed damage and will likely incur expensive engine repairs.
Salvatore is seeking compensatory and punitive damages. He is representing himself.
