BECKLEY – A Raleigh County woman is suing a grocery store chain after she was allegedly attacked in one of its locations.
Carolyn Davis filed a lawsuit Nov. 2 in Raleigh Circuit Court against Fred Derf, doing business as Save-A-Lot, and John Doe, alleging negligence.
On Oct. 1, 2014, Davis was shopping in the Save-A-Lot on Robert C. Byrd Drive in Beckley when she was allegedly attacked by the John Doe named in this suit.
The suit alleges Save-A-Lot breached its duty of care by failing to provide a safe environment. The suit further alleges Save-A-Lot knew or should have known of the John Doe's violent nature but still allowed him to visit their location.
As a result, Davis has suffered serious and permanent injuries, for which she has incurred medical expenses.
Davis seeks a judgment against the defendants in an amount justified by the evidence.
Davis is represented by attorney Greg A. Hewitt of Hewitt & Salvatore in Fayetteville. The case has been assigned to Circuit Judge John A. Hutchison.
