Green River Landscaping alleges Gray Lumber hasn't paid for services

BECKLEY – A Raleigh County landscaping company is suing a local lumber company over allegations it has not paid for services provided.

Green River Landscaping Services filed a lawsuit on Nov. 10 in Raleigh Circuit Court against Gray Lumber Company, alleging breach of contract.

In November 2014, the suit states, Gray Lumber contracted Green River to provide anticipated snow removal and salt application services on its property known as Gray Mini Storage. Green River provided these services in January, February, and March.

The suit alleges Gray Lumber has failed to timely pay the invoices for February and March, and is incurring interest and/or late payment penalties.

Green River filed a notice of mechanic's lien against Gray Lumber on May 13, but Gray Lumber has still not made any payment on its outstanding obligations, the suit alleges.

Gray Lumber allegedly still owes Green River $2,409.30, plus penalties and interest from March 10.

The plaintiff seeks to recover the unpaid sum, plus interests and costs of the suit. Green River Landscaping is represented by attorney Darl W. Poling of Poling Law Offices in Beckley. The case has been assigned to Circuit Judge Robert A. Burnside.
