Progressive Insurance seeks judgment relieving it of responsibility in local accident

BECKLEY – Progressive Classic Insurance Co. is asking Raleigh Circuit Court to resolve that it is not responsible in a claim involving a Beckley driver and a local auto dealership.

Progressive filed a lawsuit on Nov. 18 against Beckley Buick - GMC Auto Mall LLC, Beckley resident Rebecca Bradley and Auto Trakk LLC of Montoursville, Pennsylvania. The lawsuit includes documentation regarding a vehicle leased by Bradley which was covered by a policy written by Progressive and information about a loaned vehicle Bradley was using while her leased vehicle was in the shop, which Progressive claims its policy does not cover.

Progressive’s lawsuit cites a previous lawsuit by Beckley Buick against Auto Trakk and Bradley. Progressive’s lawsuit states that Bradley leased a Nissan Sentra from Auto Trakk LLC, which allegedly obtained insurance coverage for physical damage to the leased Nissan model from another insurance carrier while Bradley obtained liability and uninsured motorist coverage on the Nissan from Progressive. Documents further state that Bradley was provided a loaner vehicle, a Chevrolet Impala, from Beckley Buick while the leased Nissan was at the dealership for repair. Documents state this loaner vehicle was in an accident while in Bradley’s possession but was being driven by an unidentified driver. Progressive’s claim cites the lawsuit by Bradley Buick against Auto Trakk in which the dealership was seeking to recover repair costs and incidental costs and against Bradley to recover deductible costs related to the repair of the loaned Impala.

Progressive is seeking resolution to determine rights and responsibilities of the involved parties and a judgment that its policy for Bradley’s leased Sentra does not include collision coverage for the loaned Impala. Progressive is represented in the case by Robert A. Lockhart of Martin and Seibert LC in Charleston. The case is being heard by Judge John A. Hutchison.
