BECKLEY – A Midway miner is suing for injuries suffered at what he claims was an unsafe and negligent working environment.
Gary Edwards filed a lawsuit on Nov. 17 in Raleigh County Circuit Court against David Stanley Consultants LLC alleging negligence and an unsafe work environment.
Edwards claims while working for the Marfork Coal Co. on or about Dec. 14, 2013, the defendant negligently stacked rails together vertically approximately 2 feet high in height, instead of horizontally or side by side. While working, he bent down to talk to a co-worker and as he placed his hand on the rail to help himself up, one of the rails slid down and crushed his finger, the complaint states. As a result, Edwards had the finger amputated because of the injuries.
