BECKLEY – A man claims that a collection agency has invaded his privacy by allegedly calling him asking for more money, even after their delinquency dispute had already been resolved.
Terry VanBuskirk filed a lawsuit on Nov. 19 in Raleigh Circuit Court against Jefferson Capital Systems LLC claiming a violation of the West Virginia Consumer Credit and Protection Act, breach of contract and common law invasion of privacy.
According the lawsuit, VanBuskirk owed Fingerhut Direct Marketing $423.09. Jefferson Capital Systems bought that debt and offered VanBuskirk a reduced payment of $300, according to the lawsuit. On Feb. 24, 2014, the lawsuit claims, Jefferson Capital Systems sent him a letter confirming that it had received his $300 payment.
Still, according to the lawsuit, Jefferson Capital continued to attempt to collect $123.09 from VanBuskirk through the use of his cellphone and written communication at unusual times or at times known to be inconvenient.
VanBuskirk is represented by attorneys Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young & Pollard of Fayetteville. The case has been assigned to Circuit Court Judge John Hutchison.
