WINFIELD – Two Putnam County women claim a 40,000-pound utility truck driven by an Appalachian Power Co. employee willfully and intentionally destroyed their concrete driveway.
Angela Green and Starla R. Kerdsri filed a lawsuit on Nov. 19 against Appalachian Power Co. in Putnam Circuit, citing negligence.
On Dec. 26, 2013, Green reported a light outage at the plaintiffs' Hurricane home to the APC, and according to the lawsuit, specifically requested that no large truck come up the driveway to fix the light. On or about on Feb. 15, 2014, and again on Feb. 18, 2014, APC employees did come to repair the outdoor security night light, and according to the lawsuit, drove a large truck up the driveway to make the repairs. The claim states the truck's weight caused the concrete to crack on both occasions to the point it has to be replaced. The cost to replace the driveway is more than $16,000, according to the complaint.
Green and Kerdsri, who are seeking costs of replacing the driveway and damages for emotional distress, are being represented by attorney David L. Hill of Hurricane. The case has been assigned to Circuit Judge Joseph Reeder.
